Days of Our Lives



  1. Contest Period:  Days of Our Lives 50th Anniversary VIP Trip to LA Contest (the “Contest”) is sponsored by Sony Pictures Television Canada (the “Sponsor”). The Contest starts at 12:00:00 AM on October 12, 2015 and ends at 5:00:00 PM on October 25, 2015 (the “Contest Period”).  All times within these Official Rules and Regulations (“Rules”) reference the Eastern Time zone unless otherwise noted.
  2. Eligibility: The Contest is open to all residents of Canada (excluding Quebec) who have reached the age of majority in their province or territory of residence, except employees, representatives or agents (and those with whom such persons reside, whether related or not) of the Sponsor, its parent, divisions, subsidiaries, affiliates and advertising/promotion agencies, Twitter Inc. (“Twitter”), prize suppliers, or any entity involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Entities”).
  3. Entry: NO PURCHASE NECESSARY. To participate in this Contest, entrants must have a valid Twitter account.  Entrants who do not have a Twitter account can visit twitter.com (“Twitter Website”), as applicable, and follow the instructions provided to register for a free account. There is one way to enter the Contest:
    I.          entrants can:
    (a)        enter the Contest by sending a Tweet to @DaysofOurLives from the entrant’s Twitter account.  To be eligible, any Tweet submitted must:

      1. include the following hashtag: #Days50ContestCAN;
      2. comply with the Twitter Terms of Service and Twitter Rules available at the Twitter Website;
      3. conform to Twitter’s 140 character limit, including the hashtag; and
      4. include one (1) uploaded photograph that displays how you will celebrate the 50th Anniversary of Days of Our Lives;

    Each entrant will receive one (1) entry (each an “Entry”, collectively “Entries”) when the entrant Tweets an eligible Tweet in the manner described above and in accordance with these Official Rules and Regulations (“Rules”). Any Entry that does not follow the above format as determined by Sponsor will be ineligible for entry in this Contest.  Entries must not infringe, misappropriate or violate any third party’s rights, including, without limitation, copyright, trademark, right of publicity, right of privacy or trade secret and not contain any content that is offensive, illegal, obscene or that is otherwise objectionable to Sponsor, in its sole discretion. By submitting an Entry in this Contest, each entrant certifies that the Entry submitted constitutes the entrant’s own unpublished work, and agrees to transfer all copyright to the Sponsor, and to waive all moral rights in and to such work. Further, the entrant confirms by submitting an Entry that no other person has any intellectual property rights or other interest in the Entry submitted and, further, confirms that in the event the entrant is the winner of the Contest, acceptance of the Prize will not result in the winner breaching the terms of any other agreement with a third party. For greater certainty, each entrant shall indemnify the Released Parties (as hereinafter defined) against any liability for any claims and associated costs that may be brought against them by any third parties with respect to any intellectual or other property rights in the submitted Entry.

    Standard data usage rates may apply to entrants who submit an Entry via a wireless mobile device.  Wireless service providers may charge for airtime for each standard text message sent and received.  Contact your service provider for pricing and service plan information and rates before mobile device participation.

    PHOTO GUIDELINES: In uploading a photograph as part of an Entry in this Contest, each entrant agrees that the photograph complies with these Rules including all guidelines provided in this Rule.  The Released Parties bear no liability in connection with the use of any photograph by them or any of them and shall be held harmless by each entrant in the event it is subsequently discovered that an entrant has not complied with any of these guidelines, in whole or in part.

    Uploaded photographs must comply with the following guidelines:

    (a) Uploaded photographs must not exceed Twitter’s size requirements, as applicable;

    (b) Uploaded photographs must not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity.  Photographs must not contain or reference any names, products or services of any company or entity other than Sponsor (or an affiliate of the Sponsor), Corday Productions,  and/or the show title (“Days of our Lives”), or any third party trademarks, logos, or promotion of any brand, product or service.  Photographs may not violate any law, statute, ordinance or regulation;

    (c) Entrants are solely responsible for obtaining, prior to uploading a photograph, any and all releases and consents necessary to permit the publication, exhibition and/or use of the photograph by Sponsor in accordance with these Rules. If any person appearing in any uploaded photograph is under the age of majority in his/her jurisdiction of residence, the consent of such person’s parent or legal guardian is required before the photograph may be uploaded;

    (d) Uploaded photographs that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or that otherwise contain inappropriate content or objectionable material may not be submitted and may be removed at any time in Sponsor's sole and unfettered discretion; and

    (e) Entrants may not be, nor may they work with parties in conjunction with a photograph who are:(i) represented under a contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display a photograph in any media form; (ii) subject to an acting or modeling contract that would make a party’s appearance in an uploaded photograph a violation of any third-party rights; or (iii) under any other contractual relationship, including but not limited to guild and/or union memberships, that may prevent Sponsor from being able to use the photograph in all media in perpetuity on a royalty-free basis, without any payment or fee obligations.

    By entering the Contest, each entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use the uploaded photograph, in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her photograph in favour of the Sponsor; and (iii) agrees to release and hold harmless the Released Parties from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any related cause of action.

  4. Limit on Entries:  There is a limit of one (1) Entry per person/Twitter account permitted during the Contest Period.  For greater certainty and the avoidance of any doubt, you can enter the Contest once during the Contest Period and can use only one (1) Twitter account to participate.  If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor), that any person has attempted to: (i) obtain more than one (1) Entry per person/Twitter account during the Contest Period; and/or (ii) use (or attempt to use) multiple names, identities, Twitter accounts, email addresses, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor.  The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).
  5. All Entries are subject to verification at any time and for any reason.  The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (a) for the purposes of verifying an individual’s eligibility to participate in this Contest; (b) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (c) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules.  Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s).

  6. Prizes:  There is one (1) grand prize available to be won at the end of the contest. The grand prize consists of a trip for two to Los Angeles, California. (November 4 – 8, 2015). Trip package includes roundtrip, economy-class air transportation for two (2) from the nearest major Canadian airport near the winner’s home (determined by Sponsor in its sole discretion) to Los Angeles International Airport; five (5) days and four (4) nights hotel accommodations; two (2) admission tickets to Sony’s ‘Happy Hour’ on the SPT studio lot; two (2) admission tickets to a Sony Studio Lot Tour; two (2) admission tickets to the Days of Our Lives 50th Anniversary VIP Party; a tour of the Days of our Lives television production set (subject to availability and production schedule); $500 CAD spending money. Approximate retail value of the grand prize package is $5,000 CAD.
  7. Each Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion).  No substitutions except at Sponsor’s option.  Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater value.

  8. Winner Selection:  At the closing of the Contest Period, the Sponsor will conduct a random drawing from among all eligible Entries received by the Sponsor on Twitter immediately prior to the drawing (One (1) entry will be randomly drawn from all entries received via Twitter during the Contest Period for the Grand Prize.) Each selected Entry will be declared a Prize winner in this Contest, subject at all times to verification by the Sponsor.  The odds of winning depend on the number of eligible Entries received via Twitter immediately prior to each random drawing.
    The Sponsor or its designated representative will make a minimum of two (2) attempts to contact each selected entrant who participated in the Contest using Twitter by direct message on Twitter within two (2) hours of the draw.  If the selected entrant cannot be contacted within two (2) hours of the draw, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). 
    Before being declared A CONFIRMED PRIZE winner, each selected entrant will be required to (a) correctly answer a mathematical skill-testing question without mechanical or other aid; and (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirm compliance with these Rules; (ii) acknowledge acceptance of the Prize as awarded; (iii) release the Sponsor, the Contest Entities, and their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agree to the publication, reproduction and/or other use of his/her name, address, Entry, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet.  If a selected entrant: (a.1) fails to correctly answer the skill-testing question; (b.1) fails to return the properly executed Contest documents within the specified time; (c.1) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; and/or (d.1) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant). 
  9. 7. GENERAL:  All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.  By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 

    The Released Parties will not be liable for: (a) any failure of the Twitter Website during the Contest; (b) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (c) the failure of any Entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (d) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (e) any combination of the above.

    In the event of a dispute regarding who submitted an Entry, Entries will be deemed to have been submitted by the authorized account holder of the Twitter account at the time of entry.  “Authorized account holder” is defined as the person who is assigned a Twitter account, as applicable, that can be verified by Sponsor. An entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the Twitter account, as applicable, associated with the Entry in question.

    The Sponsor reserves the right to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. 

    By entering this Contest, each entrant expressly authorizes the Sponsor and its agents and/or representatives, to store, share and use the personal information submitted with his/her Contest Entry solely for the purpose of administering the Contest.  Visit https://www.sonypicturestelevision.com/home/ for Sponsor’s Privacy Policy regarding collection, use and disclosure of personal information. 

    Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.  In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the Twitter Website, the French version of these Rules (if any), and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law.

    The Contest is in no way sponsored, endorsed or administered by, or associated with Twitter. You understand that you are providing your information to the Sponsor and not to Twitter. The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy.  Twitter are released of all liability by each participant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Twitter.
